An Important Message About EULA's Over the past few years the end user license agreement (EULA) that comes with all software has been abused by many manufacturers, limiting their responsibility and your rights. Furthermore, many of these agreements now include the fact that additional software will be installed on your computer. This software is known as adware, spyware or malware. At the present time the EULA is a one sided agreement. The manufacturer writes it and your choice is to accept it or return the software. Most of us just click okay without even reading these agreements so we can get on with using the software. This is a bad idea but most of us can't understand the legal gobbledygook even if we do read it. Finally there is an organization that is attempting to impose some fairness in the process. I suggest you go to their site http://www.fairterms.org/ and see what is being done to shift the balance of power away from the one sided agreements that currently exist. I know that this is not an easy thing to get excited about but when you understand some of the rights you give up every time you click on one of these unfair agreements I hope you will agree that it is important that you educate yourself and take action. Only through a ground swell of opposition will these vendors modify their EULA's. Some EULA's restrict your right to transfer your software from one computer to another, to sell your computer with the software on it even if you give up all rights to the software yourself, to hold the manufacturer responsible for software that causes a loss to you, the right of the manufacturer to terminate your use of the software remotely without any notice to you or any way to resolve the issue, and the right to modify the software on your computer without your permission. All of these (and more) severely limit your rights and endanger your computer. Check out fairterms.org and see what you can do. |
